How to make the REACH Compliance deadline

REACH, the 2007 European regulation that ushered in a decade of increasingly strict chemical substance regulations, will finally complete its transitional period in May 2018.

Here is how to make sure your business meets the deadline and avoids the costs, fines and prison sentences that come with being noncompliant.

The REACH timeline

We are now in the last stage of REACH’s transitional period. Right now, all substances supplied at more than one hundred tons a year should be registered with the European Chemicals Agency (ECHA).

This means that any EU manufacturers, importers and Only Representatives who import 100tpa of any substance into the European Community – either within products or as a raw material – must collate information on the substance(s) and submit it to ECHA.

May 2018 marks the deadline by which all EU manufacturers and importers must register for masses of just 1tpa. This will affect thousands of additional businesses. Importantly, many of these will be smaller than the companies previously affected due to the smaller quantities involved.

Many cosmetics companies are likely to be now affected, too, due to the small quantities of active ingredients in many cosmetic products.

The effect on small business

Clearly, the kind of businesses that import or produce 100tpa of a substance are likely to be very different to those that import or produce 1tpa. Whereas a big importer or manufacturer will likely have in-house teams of experts ensuring their REACH compliance, small companies may struggle with the man power and expertise required to keep track of the relevant information.
